1. Agreement to Terms

By accessing and using Envi360's environmental monitoring services and website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using our environmental monitoring services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Service License

Subject to your compliance with these Terms, Envi360 grants you a limited, non-exclusive, non-transferable license to access and use our environmental monitoring services. This license does not include the right to:

• •Modify, copy, or redistribute our monitoring software or data;
• •Use our services for any unlawful or unauthorized purpose;
• •Attempt to reverse engineer or access source code of our monitoring systems;
• •Remove any copyright or proprietary notices from our services.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Envi360 at any time. Upon termination, you must cease all use of our environmental monitoring services.

3. Environmental Monitoring Services

Envi360 provides environmental monitoring services including air quality monitoring, waste management tracking, and related analytics. While we strive for accuracy, environmental data is subject to various factors including sensor limitations, environmental conditions, and technical constraints. Users should not rely solely on our data for critical safety or regulatory decisions without proper verification.

4. Data Accuracy and Disclaimer

The environmental monitoring data and services provided by Envi360 are offered on an 'as is' basis. While we employ industry-standard monitoring equipment and methodologies, we make no warranties about the absolute accuracy, completeness, or reliability of environmental data, including air quality measurements, waste tracking data, or analytical reports.

Environmental conditions can change rapidly, and monitoring equipment may be subject to calibration drift, interference, or malfunction. Users are responsible for implementing appropriate safety measures and should not rely exclusively on our monitoring data for health, safety, or regulatory compliance decisions.

5. Limitations of Liability

In no event shall Envi360 or its suppliers be liable for any damages (including, without limitation, damages for loss of data, business interruption, environmental incidents, or regulatory non-compliance) arising out of the use or inability to use our environmental monitoring services, even if Envi360 has been notified of the possibility of such damage.

Our liability is limited to the amount paid for our services in the 12 months preceding the claim. This limitation applies to all causes of action, whether in contract, tort, or otherwise.

6. Regulatory Compliance

While our environmental monitoring services are designed to assist with regulatory compliance, you remain solely responsible for ensuring compliance with all applicable environmental laws and regulations. Our services do not constitute legal or regulatory advice, and you should consult with qualified professionals regarding compliance requirements.

7. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access to our environmental monitoring services. Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We will endeavor to provide advance notice of planned maintenance when possible.

8. Data Ownership and Usage

Environmental data collected through our monitoring services remains your property. However, you grant Envi360 the right to use aggregated, anonymized data for service improvement, research, and industry analysis. We may also be required to share environmental data with regulatory authorities as mandated by law.

9. Payment and Subscription Terms

Subscription fees are billed in advance and are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice. Failure to pay fees may result in service suspension or termination.

10. Modifications to Terms

Envi360 may revise these terms of service at any time. Material changes will be communicated to users with reasonable advance notice. Continued use of our services after such changes constitutes acceptance of the modified terms.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts in the United States.

12. Termination

Either party may terminate the service agreement with appropriate notice as specified in your service plan. Upon termination, access to monitoring services will cease, though historical data may remain available for a limited period as specified in our data retention policy.
